By accessing and using this website (the “Site”) and/or placing an order, you agree to be bound by these Terms and Conditions (the “Terms”). These Terms apply to all sales and interactions with Signed by Creatives Ltd, whether within the United Kingdom or internationally. If you do not agree to these Terms, please do not use this Site.

 

Introduction

This Site is owned and operated by Signed by Creatives Ltd, a company registered in the United Kingdom.

These Terms govern your use of the Site and the purchase of any goods or services from us.

These Terms apply regardless of the country in which the customer resides and constitute the legal contract between the buyer and Signed by Creatives Ltd. In the event of any dispute, the laws of England and Wales shall apply, and the courts of England and Wales shall have exclusive jurisdiction.


Eligibility To Purchase

To place an order with us, you must:

  • Be legally capable of entering into binding contracts.
  • Provide accurate, complete, and up-to-date information.

We reserve the right to reject or cancel any order at our discretion.

 

Product Information

  • All works sold are limited edition prints created in collaboration with artists.
  • The artworks are original works conceived specifically for print and are not reproductions of existing paintings or digital prints of other media.
  • Each edition is strictly limited and will not be reissued once sold out.
  • Minor variations in paper size, signature placement, numbering, or materials may occur due to the handmade or printmaking process. Such variations do not constitute defects.
  • Product images displayed on the Site are for illustrative purposes only and may not exactly reflect the final product.

 

Pricing & Payment

  • All prices are listed in pounds sterling (GBP £) and are inclusive of VAT, where applicable.
  • Prices exclude delivery charges, customs duties, and import taxes, where applicable.
  • We reserve the right to amend prices at any time without prior notice.
  • Payment must be made in full at the time of purchase. Accepted payment methods will be displayed at checkout.
  • We use secure payment gateways and do not store credit or debit card details.

 

Order Acceptance & Contract Formation

  • Your order constitutes an offer to purchase the product.
  • A contract is formed only when we confirm acceptance of your order by sending an order confirmation email. This is separate from any automated order receipt email.
  • By placing an order, you agree to a resale restriction, which prohibits resale of the work within one (1) year from the date of purchase.
  • We reserve the right to refuse or cancel any order at our discretion, including (but not limited to) the following circumstances:
    • Product unavailability
    • Payment failure
    • Suspected fraudulent activity
    • Breach of these Terms

 

Shipping, Risk & Title

  • Ownership of the artwork passes to you once full payment has been received and the order has been dispatched.
  • Risk in the artwork (including loss, theft, or damage) passes to you upon delivery.
  • We ship using insured and trackable delivery services. Delivery times are estimates only and are not guaranteed.
  • International customers are responsible for any customs duties, VAT, taxes, and handling fees incurred upon delivery.
  • If a delivery is refused, unclaimed, or returned to us, additional re-delivery charges may apply.

 

Cancellations & Returns

UK, European and International Customers

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel within 24 hours of placing your order. To exercise this right:

  • You must notify us in writing (by email) within 24 hours of receipt.

 

Damaged or Incorrect Items

You must inspect your delivery immediately upon receipt.

  • If your print arrives damaged or is incorrect, you must contact us at info@sbycreatives.com within seven (7) days of delivery.
  • Please include clear photographs of the damage, the artwork, and the original packaging.
  • If the damage or error is confirmed, we will, at our discretion, offer a replacement or a refund.
  • We may require the artwork to be returned before processing any refund or replacement.

 

Limitation of Liability

To the fullest extent permitted by law, Signed by Creatives Ltd shall not be liable for:

  • Any indirect, incidental, or consequential losses or damages.
  • Delays caused by shipping carriers or customs authorities.
  • Losses arising from your failure to follow care instructions or from improper handling of the artwork.

Nothing in these Terms shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

Subject to the above, our total liability to you shall not exceed the total value of your order.

 

Intellectual Property

All artworks, images, branding, text, and other content displayed on this Site are protected by intellectual property laws and remain the property of Signed by Creatives Ltd and/or the relevant artist.

  • You may not reproduce, distribute, publicly display, modify, or otherwise use any artwork or content for commercial purposes without our prior written consent and, where applicable, the consent of the artist.
  • The purchase of a print grants you ownership of the physical artwork only and does not transfer any intellectual property, reproduction, or commercial rights.

 

Force Majeure

We shall not be liable for any delay or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, industrial action, postal or courier disruptions, or technical or systems failures.

 

Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales.

  • Any legal proceedings shall be brought exclusively in the courts of England and Wales, regardless of the customer’s location.
  • Nothing in these Terms shall affect your statutory rights under UK consumer law.

 

Amendments

We reserve the right to amend or update these Terms at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the Site following such changes constitutes your acceptance of the revised Terms.
